Help SCRHA Stop AB 1157 – Lower Rent Cap
SCRHA sent out an Action Alert this week asking for help stopping AB 1157 (Kalra), a bill that seeks to lower the existing statewide rent cap. The bill would also eliminate the single-family home/condo exemption and make the Tenant Protection Act (AB 1482) permanent. The bill is scheduled to be heard in the Assembly Housing and Community Development Committee on Thursday, April 24. If you haven’t acted yet, please do so as soon as possible by clicking here. *CPI reports have been released that apply to rent increases effective August 1 or later. The Max increase for San Diego will be 8.8%. For Riverside County it will be 7.5%. The state has not released the statewide number that applies to Imperial County.

San Diego City Council Passes Price Fixing Ordinance
This past Tuesday, the San Diego City Council passed an ordinance to prohibit the sale/licensing of software that uses algorithms in setting rental rates. It also prohibits housing providers from using algorithms to set rental rates or occupancy levels. The ordinance allows tenants to file a lawsuit against a housing provider if they violate the ordinance. However, SCRHA was able to secure amendments to make that section more balanced. As originally drafted, only a prevailing tenant could collect attorney’s fees and any lease provision that limits a tenant from recovering attorney’s fees would not be enforceable. SCRHA pointed out the inequity in that language and it now applies to both parties so that housing providers may also collect attorney’s fees if they prevail in a lawsuit. The ordinance must still go to a second reading. SCRHA will share any changes or updates in future messages.
